The 2009 WSOP Ladies Poker Championship was won by Lisa Hamilton. In the spring of 2007, an investigation began to seek out underground poker rooms and tournaments in Pennsylvania. One such man whose game was uncovered and who was indicted was Lawerence Burns, 65, of PA.

But Burns decided that he wasn’t going to take this laying down. He decided to fight back. A lawyer himself, Burns argued that online poker was a game of skill (Hold ‘Em specifically), but the jury wasn’t buying it. Burns was found guilty by a trial of his peers for “allowing people to gamble, inviting others to gamble, and allowing gambling on a premises under his control.”

But Mr. Burns’ is just one of many of the cases that will cross the US court system. With several other states already ruling that poker was a game of skill and not a game of chance, Burns’ may have quite a bit of research to do to convince an appellate court that the game he loves is one of skill primarily with only an element of chance sprinkled in.

And Burns is doing just that, appealing. When members of congress such as Senator Menendez and Rep. Barney Frank are trying to introduce legislation that would regulate and legalized online poker, it only seems to logically follow that home games will soon follow and poker will not be placed under the archaic gambling laws that arose during the prohibition era. It makes me wonder if the PPA will get involved in Burns case as well. After all, the jury of his peers weren’t experts of the game nor of sociology most likely, so hopefully Burns’ appeal will have a different outcome and yet another state will jump on the skill bandwagon.
